Slot Machine Charge II Dropped in San Antonio Case

E H Kerty Tolbert, a San Antonio attorney and former justice of the peace, faced charges of keeping and exhibiting a slot machine for gaming. District Judge W W McCrory dismissed the indictment on motion by District Attorney John R Shook, after evidence failed to link Tolbert to the exhibit. Talbert had been indicted March 2 with Frank Shivel and Albert Labinski following a Legion club raid on Highway 66 South. The district attorney noted Tolbert severed ties with the Legion club in September 1939, and he was not present at the exhibit nor shown to have any connection, the dismissal motion claimed. The grand jury appears to have relied on a county clerk name record.
