Guffey coal tax halted by federal judge ruling
Federal District Judge Albert L. Reeves declared the Guffey coal tax unconstitutional under the taxing powers of the constitution. He ruled the levy burdensome enough to destroy plaintiffs business and blocked federal collection while Missouri coal companies challenged the act’s validity. Reeves said the tax acted as a penalty to force compliance with a national regulatory order and found no constitutional authority for Congress to stabilize the bituminous coal industry or regulate interstate commerce.
