Manitoba law shields farmers from machinery dealer fraud
Manitoba farmers are protected by Section 21 of the Farm Machinery Act which limits liability when a dealer goes bankrupt. If a finance company fails to notify within 30 days by mail of new financing, the farmer may view the dealer as the finance company’s agent. Dealers must post a penal bond up to 12 000 dollars to reimburse farmers, though few claims have been needed in ten years.
