Court nixes evidence in Roswell narcotics case
The New Mexico Court of Appeals ruled that Roswell police violated the Fourth Amendment by conducting an unlawful search and seizure and that marijuana found cannot be used as evidence. The ruling overturned a district court denial to suppress the marijuana and involved Kenny P. Reynolds charged with possession of more than eight ounces. The judge noted lack of probable cause and no warrant.
