Thresherman's Lien Law Clarifies Filing and Enforcement
The legislature passed a lien law allowing a thresher or cornsheller a first lien on grain for a valid threshing or shelling bill. Statement must be filed within ten days after service with the clerk of courts, and proceedings to enforce the lien must begin within thirty days after filing. The lien attaches regardless of who ultimately receives the grain. If grain is sold directly to a grain dealer, the dealer must be notified to protect the lien, as the ten day filing window may be too late to delay payment. The thresherman must act to protect himself in direct sales from the machine.
