Manitoba Court of Appeals overturns drainage conviction
The Ninga-area farmer Hildebrandt had his conviction for draining land without a permit overturned by the Manitoba Court of Appeals. Justice Bonnie Helper ruled municipalities, not the province, hold drainage jurisdiction when no provincial waterway is involved, ending a three year dispute and setting a provincial precedent. Hildebrandt was charged in 1997 under the Water Rights Act, initially won, then convicted and fined one dollar on appeal.
