Fayette County Circuit Judge John Hatcher issued a temporary restraining order against the state DEP at the request of land owners Paul and Renee Lansat and Sun Mountain Enterprises Inc. He said digging coal on part of the 30 acre Sun Mountain site near Mount Hope may be the only practical option to clear and flatten the land for the planned outdoor amphitheater, with 18 000 to 23 000 tons of coal needing removal before proper surface elevation can be achieved.
