Hugh M. Caperton, owner of Harman Mining Corp, filed a suit in Boone County Circuit Court against A T Massey Coal Co alleging the firm forced him out of business and into bankruptcy. Caperton reopened the Grundy Virginia mines, hired 120 miners, and had a contract with the United Mine Workers before Massey allegedly acquired Wellmore Coal reserves to hurt his company.
