Judge Attorneys to Decide Next Step in Constable Case
Princeton report states Judge Walter V. Ross will oversee a conference with Mercer County Criminal Court and the defense and prosecution to determine the next action in the alleged attempt to steal an $80 000 payroll involving constable Bluefield. Defendant Tom Bivens 41 recently returned to Mercer County Jail from Weston State Hospital after examination following July arrest at Huntington airport. He may face the next grand jury on the charge. Weston findings note no evident mental disorder affecting responsibility though diabetes and alcohol may have impaired judgment due to missed treatment and temporary amnesia. Bivens was sent back Thursday for observation after prior jail examinations by local doctors. He is housed in a private first floor cell alongside juveniles and receives diabetic meals from Memorial Hospital daily.
