Judge rules to quash Beckley Elks slot indictment
Judge Harry L. McCreery sustained defense motions to quash the Grand Jury indictment against the Beckley Benevolent Protective Order of Elks Lodge No. 1452 and manager Roland Phillips. The six page ruling centers on the validity of the police search and seizure warrant issued for slot machines at the Elks Club after an informant’s telephone tip. The decision cites West Virginia and U.S. Supreme Court precedents on probable cause and the illegality of evidence obtained by unlawfully conducted searches.

The court holds the Elks Club raid invalid due to lack of probable cause and oath. A telephone tip to Chief Hall did not meet legal standards for issuing a search warrant, violating West Virginia statutory safeguards. The judge grants the motion to quash the indictment and declines other pleas.
