New Trial Ordered In Wrongful Death Suit
The West Virginia State Supreme Court ordered a new trial for Harry Cockill who was previously required to pay 7000 dollars in a wrongful death case and 741 dollars for funeral expenses. The suit, filed by M. L. Jackson as administrator for Spurgeon Hancock, argued Cockill was negligent as Hancock was struck by a car on January 17, 1962. Judge Thornton Berry ruled that pedestrians must use eyes to avoid danger and noted 1961 amendments prohibit recovery of funeral expenses in such suits.
