Alabama Court upholds election day speech limits case
Alabama Supreme Court rules free speech protects not enough to overturn a ban on election day politicking. The decision, by Chief Justice J Ed Livingston, orders Jefferson County to retry James E Mills editor of the Birmingham Post Herald for alleged Corrupt Practices Act violations from a November 1962 editorial urging a mayor council form vote. The court says the act regulates electioneering within police power to maintain orderly elections, preserving press and citizen speech.
