Court Grants Review of Fayette Custody Case

The West Virginia Supreme Court granted a 4-1 review of a Fayette County order that held Betty Stout transferred custody of a child born out of wedlock to R. D. Massie and his wife of Gatewood. The lower court ruled the adoption to the Massies void but found custody transfer valid. Mrs. Stout, now married, argues she should have custody as she can care for the child. The record notes she left the child at the Massie home during extended employment out of state. Massie is Stout’s sister.
