Smith To Fill Court Vacancy In McDowell
Charleston reports the state attorney general advised McDowell County that the county court vacancy should be filled by a gubernatorial appointee of Gov. Hulett C. Smith. Murensky noted one of three commissioners resigned, leaving one eligible but with no quorum to rule on estate cases. The opinion says the governor must appoint a qualified McDowell County citizen of the same party as the resigned commissioner until the next general election. The governor’s office had not received a request.
