West Virginia Supreme Court unanimous ruling voided a state law that let the governor appoint a county commissioner when two court members cannot agree on a third. The decision leaves a vacancy in McDowell County Court. Governor Smith had earlier appointed Walter Basham to fill the seat after R L Martin resigned, a move challenged as unconstitutional. The court held vacancies in county courts must be filled by the county court until the next general election.
Mrs. June La Cross, 49, of Windsor Heights, died when her car hit the rear of a stopped interurban bus in Warwood. The crash raised the 1965 road death toll to 454. Fourteen bus passengers were injured and a passenger in the La Cross car, Mrs. Rees Sandreth, 40, suffered minor injuries.
Maj. Thomas Bransford commander of the Army Recruiting Main Station for a three state area receives orders to report for duty in Vietnam after six weeks of Civil Affairs School training at Fort Gordon. The controversy over moving the station from Beckley to Charleston drew opposition from Sen. Byrd and was resolved with the Beckley office remaining in place.
West Virginia power suppliers told the Public Service Commission that a massive blackout, like the Northeast outage of November 9, is unlikely but possible. Representatives from Appalachian Power, Monongahela Power, Virginia Electric and Power, Potomac Light and Power, and Wheeling Electric cited interconnections with other firms and safeguards under study to prevent a repeat.

UPI reports a Gemini 7 mission and a Echo 2 satellite passing 435 miles apart prompted talk of scary moments. Director Christopher Kraft denied any collision risk and said no such moments occurred while Gemini 7 astronauts were asleep.
