Court Refuses To Hear Cabell Controversy
The state Supreme Court refused to intervene in a Cabell County Democratic Party dispute over the election of state Sen. Robert R. Nelson of Huntington as county chair. In a 4 1 decision, justices ruled seven party executive committee members lacked clear legal right to reconvene to reconsider Nelson’s election. Nelson won earlier by 8 7 after a proxy ballot was disallowed. The court also upheld a 7500 wrongful death verdict against Norfolk and Western Railway Co. for Ivan Branham’s death near Matewan, stating contributory negligence issues remain for the jury to decide where evidence conflicts.
