Khanh Declares State of Emergency in South Viet Nam
Premier Nguyen Khanh declared a state of emergency suspending laws against strikes and demonstrations and decreeing death with no appeal for saboteurs and terrorists. He said North Viet Nam could attack at any moment and planned to visit the front as U.S. forces reinforce in-country air power. He urged North Vietnamese residents to rise up and strengthen civil defense amid looming confrontation. The United Nations Security Council agreed to invite both Viet Nams to discuss the Southeast Asia crisis, though North Viet Nam likely would refuse if South Viet Nam attends.

The House and Senate considered President Johnsons fight if we must resolution to confront the Viet Nam crisis. Sen Wayne Morse opposed the plan arguing caution, while Congress anticipated a bipartisan approval. The measure, prompted by North Vietnamese attacks on U S destroyers in the Gulf of Tonkin, seeks any steps Johnson deems necessary to repel communism in Southeast Asia and defend allies.

NLRB wipes out miners contract clause on hot cargo ban
National Labor Relations Board ruled a contract provision between major coal operators and United Mine Workers Union illegal. The clause required double royalties to the UMW welfare fund for coal not mined by UMW members and imposed 80 cents per ton on coal bought from non-signatory firms. The board, in a 4-1 decision, said the double royalty amounted to a restraint on buying non signatory coal.
