Oceana Officials Ordered to Mandamus Hearing
Oceana town officials must appear before Wyoming Circuit Court Judge Robert Worrell in Pineville to show cause why James I. Harless's name should not appear on the June 1 mayoral ballot. Harless seeks a writ claiming the recorder must place filing candidates on the ballot and that the council lacks authority to disqualify him. He cites a felony conviction as grounds but argues no statute disqualifies him from local office. Harless previously filed March 9 and had his filing fee returned. he alleges a frameup and that West Virginia's disqualification provisions apply only to state offices. The hearing is set for 10 a.m. Wednesday. Mayor Leland Tilley and councilors Puckett, Mathis, Argie Cozort, Beane, and Adams are ordered to appear.
