California bank bandit wins in high court on Gideon ruling
The Supreme Court, in a 5 to 2 decision, orders resentencing for Forrest Tucker, a California bank robber, citing the 1963 Gideon right to counsel. Justice Stewart leads the majority against the misapplication of constitutional rights, while Burger and Blackmun dissent from the harsher stance. Tucker had received a 25 year term based partly on prior felonies later deemed unconstitutional due to lack of legal aid. The opinion notes Tucker’s prolonged confinement, including a 50 year chain gang term, and frames the ruling as a correction of constitutional misapplication by the Harris court. The Nixon appointees Powell and Rehnquist did not participate.
