Supreme Court OKs forced retirement rules
The Supreme Court ruling holds the Age Discrimination in Employment Act does not shield some workers from forced retirement before 65. In a 7-2 decision, the court said the law aims to boost older-hiring, not bar pension-plan retirements. Justice Marshall and Brennan dissented, warning the ruling undermines Congress protections, noting recent amendments to curb forced retirement of under 61-year-olds may shorten the issue. The case involved Harris McMann of Alexandria, a 1944 employee of United Airlines who was forced to retire at 60 in 1973. The act covers ages 40 to 65 and allows bona fide retirement plans unless used to dodge the ban.
