McCarthy appeal heard on license suspension case
The appellate department of the Superior Court heard arguments in Los Angeles on whether Robert McCarthy should answer a contempt charge for suspending licenses of two first time drunk driving defendants contrary to a local judge’s recommendation. The court must decide on a writ of prohibition to bar McCarthy’s appearance and a writ of mandate to require restoration of licenses to their former holders. The licenses involved belong to John Walters and Jack Bear, who pleaded guilty to misdemeanor drunk driving. Judge Swain Hull and David had set probation and not suspended the licenses, while the PMV suspended them for six months under its policy on drunk drivers.
