McCallin Ex-Major Defends Bond Sureties in Doerflinger Case

Attorney for ex Major McCallin asserts the Modern Building and Loan Association cannot hold Theodore Doerflinger and Augusta Doerflinger liable on the bond as sureties. He argues the plaintiffs’ affidavit was premature and the association failed to audit accounts, misled the public, and neglected oversight, rendering the sureties nonli able. The defense contends embezzlement, if any, occurred before 1891 and the plaintiffs were negligent in not discovering it earlier. The suit seeks £5,000.
