Desert Land Entrymen May Finalize Proof Without Water Right Certificate

Deseret Desert land entrymen may complete final proof and obtain tithe on desert claims before securing a final water right certificate. The U S General Land Office ruled that a water right permit issued by the state engineer serves as sufficient authority to construct and apply irrigation, with final water right certificate or deed to follow after irrigation begins. The ruling shields isolated desert claim holders, such as those near Denio, from mandatory water certificates prior to proof, requiring only a certified permit copy and a State Engineer statement if noncompliance is not the issue.
