Is the election legally called in Pella telephony vote

The Chronicle reports a September 24 special election for a W H Fowler telephone franchise, but legal questions arise over whether city code requires a general ordinance or a petition from property owners. The Iowa code sections on regulations and franchise elections are cited, with debate on whether Pella’s past practice and lacks of a general ordinance justify the call. The state Supreme Court would decide the interpretation if challenged, and readers are urged to form opinions based on the cited code.
