Bond Forfeit Upheld In Iowa Bond Case By Supreme Court
Iowa Supreme Court sustained a district court ruling that a criminal defendant who fails to report when court is called forfeits his bond even if later captured and convicted. Elmer Hamilton’s $8,000 bond was forfeited after he fled to the Mexican border and was later apprehended, tried, and sent to the penitentiary. Bondsmen were made to pay $8,806.65 with interest and costs. Similar earlier case in Shelby county followed the same principle.
