Court review on wind generator classified as utility
James W. Moore seeks court exemption from county zoning for a 100 foot high wind generator built to power his Stilwell office. Johnson County inspectors and seller say it is a utility, exempt from local height limits, while county planners demand a special-use permit. Moore argues neighbors object none and federal law requires purchase of excess power by the local utility.
