Blue Cross Sues Over Corporate Status In Kansas Action
Blue Cross and Blue Shield of Kansas sues Attorney General Carla Stovall in Sedgwick County District Court to confirm its pre 1992 corporate status. The suit argues the company was a non profit medical and hospital service corporation before becoming a mutual insurance company in 1992 and that policyholders acted like shareholders. Stovall contends the firm resembled a public benefit charity with charitable trust obligations possibly forcing asset restitution to Kansans. The case follows fallout from a proposed merger with Blue Cross and Blue Shield of Kansas City and a separate action by Missouri AG Jay Nixon declaring that merger illegal.
