Franklin suit dismissed against federal government in Kansas City
Federal judge in Kansas City dismissed one of two lawsuits by Franklin Savings Corp owners of Franklin Savings Association Ottawa against the FDIC. The ruling: monetary damages claims under the Administrative Procedures Act lack jurisdiction and the Tort Claims Act discretionary function exception shields the agency. The 1990 seizure led to RTC asset transfers and later litigation, with prior verdicts and settlements shaping the remaining case.
