New Liquor Price Law Challenged
TOPEKA AP Constitutional validity of Kansas new liquor price fixing law is challenged by 17 distillers representing 75 percent of state distilled spirits. The law, set to take effect Aug 1, would require distillers to sell to Kansas wholesalers at their lowest price anywhere in the U S and allow state price setting at wholesale and retail. A Shawnee County District Court temporary order blocks enforcement pending a July 14 hearing on a request for a temporary injunction. Distillers claim the measure serves no public policy and exceeds police power and that ambiguity in affidavits blocks compliance, arguing it regulates commerce beyond state borders.
