Liquor Price Fixing Suit Delayed In Kansas
A hearing on challenges to a new Kansas liquor price fixing law was postponed indefinitely by agreement of the state and 17 distillers. The temporary restraining order against enforcement remains in effect until pleadings are filed and the merits are heard, likely by mid August. The case will likely be appealed to the Kansas Supreme Court, with a decision hoped before year end. Distillers contend the law’s provisions lack public policy and exceed police powers, notably a section forcing sales to Kansas wholesalers at the lowest price offered anywhere in the United States.
