Public Comment and EPA Review Windows for Permit Objection
The EPA has a 45 day concurrent review period with a 30 day public comment period to object to the proposed permit. If no written objection is filed in 45 days, any person may petition the EPA administrator for review. A 60 day petition period follows the 45 day EPA review. Contact KDHE to check if the EPA 46 day review is waived. Patricia Scott at EPA Region 7 provides details on when the 45 day ends and the 60 day begins.
