CURB objects to Western KC P&L merger plan
The Citizens' Utility Ratepayer Board asked Kansas regulators to dismiss the Western Resources and Kansas City Power and Light merger. CURB cites Western’s claimed backing out of the February agreement, though Western’s December statement did not reference that. Ruling finds unwritten policy created by observation order
The court ruling states no written city policy required Totton's custody but an unwritten policy to shield a third party existed when Fitzgerald told Weidl to watch Totton leave the club. The court declines the blanket duty claim, noting the officer's oral instruction fell under discretionary function and did not establish a special plaintiff duty. Totton serves 64 months in a Wichita work release for three counts of aggravated battery and felony DUI, with July 20, 1998 set for release.
