Court Rules FDA Lacks Authority Over Tobacco Regulation
A 4th U.S. Circuit panel reversed a prior ruling, saying Congress did not intend to delegate tobacco oversight to the FDA. The decision blocks FDA rules requiring IDs for tobacco purchases and limiting vending to adults only, while state and local laws remain unaffected. The Clinton administration plans a rehearing request, and the regulations stay in effect for now. Prominent figures include President Clinton and tobacco industry spokesman Scott Williams. Greensboro, North Carolina, is noted as the ruling location.
