Nichols seeks ban on death penalty in bombing case

Terry Nichols, asking for a third time, seeks to block federal prosecutors from seeking the death penalty. His motion argues the Eighth Amendment bars execution for an accomplice unless he played a major part with reckless indifference. A hearing on disqualification of Oklahoma prosecutors is also set after noon. Nichols faces murder conspiracy and weapons counts in the Alfred P. Murrah Federal Building bombing that killed 168 and injured 500 plus. Timothy McVeigh was sentenced to death after conviction on similar charges.
