High court to hear case on damages for death of fetus
Kansas Supreme Court will hear arguments over whether a Miami County couple can claim damages for the death of their unborn grandchild in a traffic death. Christina Shelton was nine months pregnant when she and the fetus were killed in Louisburg on January 2, 1997. The driver pleaded guilty to vehicular homicide and a jury previously awarded $100,000 for Christina’s death and $55,000 for the fetus. The defense argues Kansas law does not compensate for an unborn child’s death.
