Plea Is Made For New Trial In Kincaid Murder Case

SAN ANTONIO Staff No hearing date Friday set for motion for new trial in the John Russell Kin caid murder case as defense lawyers claim deception led to a guilty plea. Kin caid, 21, pleaded guilty in 187th District Court to the murder of his mother and stepfather Mr and Mrs J Bert Kin caid on Jan 21 1970. Defense attorney Warren Burnett said they were lied to and had been promised probation for 10 years, but Judge John Benavides denied probation at the Dec 20 sentencing. Burnett said prosecutors and judge gave firm commitments about probation. Pecos County District Attorney Dixon Mahon advised the court that the state does not oppose probation. If overruled the motion, Burnett would appeal to the Texas Court of Criminal Appeals and possibly federal courts.
