Appeals court rules FDA lacks authority to regulate tobacco
A 4th U.S. Circuit Court of Appeals panel reversed a lower court and held the FDA cannot regulate tobacco under the Food Drug and Cosmetic Act. The ruling leaves in effect 1996 rules requiring photo IDs for minors and restricting vending machines, while noting state laws remain unchanged. The Clinton administration plans a rehearing request and vows further tobacco legislation.
