Barry Faces Retrial After Hung Jury In Cocaine Case
On September 7 1989 the jury hung on the three felony perjury counts and could not reach a verdict on a cocaine possession charge from an FBI sting. Barry’s smoking scene with Rasheeda Moore at Vista Hotel on January 18 was shown in the FBI tape. One cocaine possession conviction carries up to a year in jail and a $100 000 fine. U S Attorney Jay Stephens will review the case before a potential new trial. NAACP leader Benjamin Hooks urged against retrying Barry citing racial concerns. Barry had faced ten cocaine possession counts three perjury counts and one conspiracy count. The mayor insisted he never used cocaine except the sting night, a detail Mundy noted the government failed to prove. The verdict left Barry stonefaced as the mistrial was announced.
