Sheriff Crave of Frederick brought Dr Wagner to Judge John E Smith by writ of habeas corpus seeking release from jail over a court imposed fine and rent. Judge Smith discharged Wagner from custody saying the commitment cited only contempt and had expired, releasing him on the writ.
Deswarnes Aug 51 report says four men were shot during a trail before Justice Null at Fairview school house near Howard yesterday morning. C H Terry had been disarmed days earlier by Reed and Estes who arraigned him for larceny. Reed and Estes arrived with a revolver and a club, attacked Terry, who fired, killing Reed. Terry was shot, an unknown bystander wounded, about a dozen shots fired.
Reports say Chief Engineer Melville of the Arctic expedition has applied for leave to command a new Polar expedition to reach the pole by way of Framland. Cy had Jr plans to provide half the funds, and the New York Yacht Club donors have offered to cover the remainder.
A sleeping-car on an American Circus train traveling from Coln to Salt Lake via the Cree lew and Pacific railroad caught fire near Crree ley. The car held roustabouts and five others perished and ten were seriously burned. The blaze began from an open torch used while the car was being talliged. An explosion preceded the inferno. Authorities suspect embers from the car or the torches caused the disaster.
Three boys from Poughkeepsie area aged 14 to 19 terrorized farmers in Ulster County territories. They camped as pirates, stole goods, killed livestock, and looted farmhouses near the Rio Grande. Captured by Esopus posse they faced burglary charges and 30 day sentences, with grand jury action pending.
