Court Action Likely on Federal Absentee Ballots in Fourth District
Baltimore October 30 court action to determine validity of about 40 percent of Federal absentee ballots appeared likely after both Fourth Congressional District candidates volunteered to join. Republican Daniel Ellison and Democrat George H. Fallon said they would participate. The Maryland War Ballot Commission suggested inviting opponents for petitioners. Ballots at issue lack an affirmative check mark for prior State ballot request before Sept 1 and nonreceipt by Oct 1. Governor O Connor ordered the suit to begin. Ellison urged the War Ballot Commission to decide the point without court action, arguing liberal construction favors validity.
