Court rules MontCo visitation decision improper
Maryland's highest court ruled the Montgomery County juvenile court erred by delegating visitation decisions to the county DHHS and a state appointed therapist. The 7 year old Mary M was in care after abuse and substance abuse concerns. The court said only the judiciary may decide visitation and must retain no visitation orders until an affirmative finding of safety. The decision was written by Lee Battaglia with judges Ekbridge Baker Wilner Cathell Harrell Jr. Karwacki on the panel.
