Judge denies appeal by attempted rapist
James Maxwell Gibson, a 34 year old man serving life plus 15 years for kidnapping and attempted rape, has had his appeal denied by Frederick County Circuit Court Judge John H. Tisdale. The court found his multiple claims of trial and counsel errors unfounded, upholding the conviction and sentence for crimes including attempted first degree rape, kidnapping and use of a handgun. The ruling follows prior rejection by Maryland’s Court of Special Appeals and reiterates the state’s position that Gibson posed a violent, dangerous threat and showed no remorse.

Mental evaluation sought for man convicted of assault arson
Charles Leonard Hallex, 59, pleaded guilty to assault with intent to maim his estranged wife and arson of a dwelling. A mental evaluation will be part of the presentencing investigation. Incidents occurred Sept 6, 1995, with hospital treatment for both spouses and $80,000 in fire damage. Sentencing set for late November.

Skies Clear in Northeast as Flood Warnings Persist
The Northeast and much of the Midwest reported clear skies at daybreak while the South and Northwest stayed cloudy. Heavy rain in Brownsville Texas caused at least one drowning as nine inches fell, with four to six inches more possible through the weekend. Emmitsburg Woman Injured in Mountaindale Bethel Crash
An Emmitsburg woman Lori Knott 35 was flown to Maryland Shock Trauma Center after her Ford Explorer collided with a Dodge Spirit driven by Chris Gibbons 17 of Frederick as he pulled from Bethel onto Mountaindale Road Friday morning. Knott was treated and released. Gibbons uninjured.
