Montgomery Charter Case Is Argued
Annapolis Oct 5 The Court of Appeals heard that a Montgomery County charter ruling creates a dilemma for county government Four appellants seek reversal or modification County Commissioners and Maryland National Park and Planning argue the charter as amended makes county government impossible A county manager and seven member council would take over local lawmaking from the State Legislature The case centers on deleting and restoring charter provisions to place the measure on the November ballot Judge Woodward and Prescott found the revised charter workable but attorney Hubert Schneider of Bethesda calls the deletion fundamental and asks for the charter to be declared unconstitutional The Board of Elections charter board and committee defend the original proposal The Appeals Court must sustain or strike down the entire instrument to resolve the dilemma If invalid the County Council could fund a June session with May legislative work The court says funding is a legislative function and the desirability of the charter would be up to citizens to decide
