Ethics panel rules conflict of interest with FOP tip jars
Frederick County Ethics Commission ruled a conflict of interest exists with deputy sheriffs lodge 102 receiving tip jar profits in taverns. Lodge President Tom Henry disagreed, calling the law applicable and the organization legal. Sheriff Carl Harbaugh, seeking re election, said the probe was politically motivated and noted jars were found in three bars after he learned last spring. The commission noted duties enforcing liquor and gaming laws create a conflict when soliciting jar placements, with 70 percent of earnings to be shared by fire companies and other charities and 30 percent to the host tavern, while the lodge earmarks 80 percent for a lodge building and remaining funds for police Olympics and community groups. The ruling cautions about public perception of unethical conduct and the use of office prestige for private gain. Sheriff Harbaugh praised the commission’s work, and attorney Mike Marshall argued the sheriff faced an ongoing battle with the FOP.
