Lester S Birely former president of the Thurmont Bank pleaded guilty to misappropriation of funds totaling more than 6800 admitted for 4230 90 and was fined 1000 and sentenced to serve one year and a day in a federal penitentiary Judge Chesnut ruled the fine would be without commitment if unpaid The defalcations occurred in 1936 and 1937 while he served as executor and withdrew funds from the bank accounts The court noted the need to expose financial betrayal to deter others and protect the community
