Overruled Motion to Quash Indictment in Arson Case
In Ellicott City yesterday the Howard county court overruled the motion to quash the indictment for arson found against Frederick Hooker by the Frederick county grand jury. Attorney Hayden attempted to cite irregularities in the grand jury finding and proceeding but objections halted that line. State's Attorney Worthington testified. Howard's Burke objected, but Burke admitted chairing the grand jury room during the investigation. Residents were summoned to Ellages Oisy on Thursday to oppose the motion to squash the indictment. Warerington argued grand jurors cannot testify to impeach their action or invalidate an indictment, a point the court sustained and none of the twenty summoned jurors were allowed to testify.
