New York Court of Appeals upholds "under God" in school pledge
The New York Court of Appeals unanimously sustains including the phrase in the pledge recited in public schools. Justice Isadore Bookstein rejects a favored status for nonbelievers, stating the First Amendment does not privilege disbelief over belief. The ruling echoes Potter Stewart's dissent on school prayer and hints at possible future shifts at the federal level.
