Inheritance Tax Decision Upheld in Baumgardner Case

The Attorney General affirmed a ruling on joint tenancy in an estate dispute. It holds that property held by husband and wife with a third party is split as one half to the spouses as tenants by the entirety and the other half to the third party. When the third party’s interest passes to the survivors, the inheritance tax applies at one percent to that share. The Baumgardner case clarifies tax on such transfers and joint tenancies.
