Jurors to Deliberate Malpractice Case Against Cardiologists
Jurors begin deliberations in a multimillion dollar medical malpractice suit against Frederick cardiologists Jeffrey N. Cowen and Sherman Kahan. The trial opened May 21 after jury selection. Plaintiff James Richard Peyton, 36, of Middletown, accuses the doctors of failing to treat his heart ailment before a February 1968 stroke left him with right brain injury and left-side disability. Peyton seeks over 33,000 in medical bills, 1.6 to 1.7 million in lost wages, and damages for pain, suffering and loss of marriage companionship. Defense contends Peyton exaggerates damages and argues the doctors should not be held to standard of care due to a rare infection.
