Conviction in Draft Case Upset by Supreme Court

The Supreme Court ruled 7 to 2 that a draft registrant satisfies the requirement to keep the board informed of his whereabouts if he provides forwarding addresses through which he can reasonably expect to receive an induction notice in time to report. Homer Lester Bartley of Houston, Texas, had his conviction overturned for failing to keep the board advised of his address, after he joined the Merchant Marine and allegedly informed unions and offices of a pending letter. The decision also touched on liberal construction of the Soldiers and Sailors Civil Relief Act in other cases involving military absence from court and defense of civil suits.
